Digital Derek Terms of Service
Effective date: 12 September 2026
These Terms of Service govern your use of the Digital Derek website, member platform and membership service.
Digital Derek is supplied and commercially operated by West Pro Media Services Ltd, in collaboration with Derek McGillivray trading as A Happy Medium, Digital Derek’s knowledge and content partner.

By creating an account or purchasing a Digital Derek membership, you agree to these Terms.
1. What Digital Derek is
Digital Derek is an AI-supported personal reflection service built around Derek McGillivray’s approved knowledge, teachings, experience, stories and perspective.
It is designed to help you pause, reflect, consider different perspectives and think about your own choices and next steps.
Digital Derek is a separate service from Derek’s direct one-to-one work through A Happy Medium.
2. What Digital Derek is not
Digital Derek:
- is not Derek personally responding to you in real time
- does not predict your future
- does not make decisions for you
- is not counselling or therapy
- is not a medical service
- does not provide professional medical, psychological, therapeutic, legal or financial advice
- is not an emergency or crisis service
You remain responsible for your own decisions.
Where you need professional, specialist or urgent assistance, you should seek appropriate help rather than relying on Digital Derek.
3. Who can use Digital Derek
Digital Derek is currently available to people aged 18 or over.
Membership is personal to the named member.
You must not share your account credentials or allow another person to use your membership as their own.
You are responsible for providing accurate account information and keeping your login details secure.
4. Membership price
Digital Derek membership costs:
£19 per month, including any applicable taxes.
Membership is billed monthly after any applicable free trial.
There is no minimum long-term membership period.
5. Seven-day free trial
New eligible members receive a 7-day free trial.
You must provide valid payment details when starting the trial.
No membership fee is charged when the trial begins.
Unless you cancel before the end of the trial, your membership will automatically continue and the first £19 monthly payment will be taken at the end of the 7-day trial.
The free trial is available once per person/account.
If you cancel during the 7-day free trial, access to Digital Derek ends immediately and no monthly membership payment will be taken.
6. Reflections during the trial
Your 7-day free trial begins with 35 Digital Derek reflections.
These trial reflections are provided so you can experience Digital Derek properly during the trial.
If you continue into paid membership, your allowance resets to a new 35 reflections when your first £19 payment is taken.
Unused trial reflections do not carry over into paid membership.
7. Monthly reflection allowance
Paid membership includes 35 Digital Derek reflections during each monthly billing cycle.
Your monthly cycle is based on your individual membership billing date, not the calendar month.
Your allowance resets to 35 on each new paid billing cycle.
Unused reflections do not roll over into the next cycle.
One reflection is used when Digital Derek generates a new reflection for you.
The following do not use a reflection:
- reading previous reflections
- viewing your journal or history
- viewing or managing your account
- using voice transcription before generating a reflection
If you use all 35 reflections, you will not be able to generate another reflection until your next allowance reset.
You can continue to access your account, journal and previous reflections during that time.
Additional reflection packs are not currently part of the standard membership.
8. Automatic monthly renewal
Unless you cancel, paid membership automatically renews each month using the payment method associated with your membership.
The recurring price is £19 per month, including any applicable taxes, unless you have been notified of a future price change in accordance with these Terms.
9. Cancelling your membership
You can cancel Digital Derek at any time.
During the 7-day free trial
Cancellation takes effect immediately. Your Digital Derek access ends and you will not be charged the monthly membership fee.
After paid membership has started
Cancellation stops future renewal payments. You may continue using Digital Derek until the end of the monthly billing period you have already paid for.
After that date, paid member access ends.

10. Statutory cancellation rights
Your contractual right to cancel Digital Derek at any time is in addition to any cancellation rights you have under UK consumer law.
When joining online, consumers may have a statutory 14-day cancellation period beginning after the contract is entered into.
Because Digital Derek is intended to be available immediately, when you start your trial you will be asked to expressly request that supply of the service begins during that statutory cancellation period.
If you exercise a statutory right to cancel after paid service has begun during that period, West Pro Media Services Ltd may, where permitted by law, retain or charge a proportionate amount for the service supplied up to the time of cancellation.
This does not affect any statutory rights you may have where a service is faulty, not provided with reasonable care and skill, not as described or otherwise fails to meet legal requirements.
11. Checkout information
Before you confirm membership, the checkout must clearly display:
- the 7-day free-trial period
- the recurring price of £19 per month including any applicable taxes
- that payment details are required when the trial begins
- that the first monthly charge will be taken automatically when the trial ends unless you cancel
- how to cancel
- that the membership renews monthly
The final order button must make clear that continuing will create a payment obligation after the free trial unless the membership is cancelled.
12. Payment processing
Membership payments are processed by West Pro Media Services Ltd using Stripe.
You are responsible for ensuring your payment information remains valid.
If a recurring payment cannot be collected, we may retry the payment, ask you to update your payment method, restrict membership access or suspend the membership until payment is resolved.
Digital Derek does not store full payment-card details itself.
13. Refunds
If you cancel a paid membership, you will normally continue to have access until the end of the billing period already paid for.
We do not normally provide partial refunds for unused days or unused reflections within an existing paid billing period.
This does not affect your statutory consumer rights.
If you are charged twice in error, charged an incorrect amount or there is another verified billing error, we will correct the error and provide any refund that is due.
14. Personal use
Digital Derek membership is for your own personal, non-commercial use.
You must not:
- share your membership with another person
- resell access
- systematically copy or extract Digital Derek content
- attempt to obtain or reproduce the underlying knowledge base, system instructions, prompts or technical configuration
- use Digital Derek content to create or train a competing service without permission
- interfere with the security or operation of the platform
- attempt unauthorised access to another account, administrative area, system or data
- use the service unlawfully or in a way intended to harm another person
15. Your content
You retain ownership of the original information, text and other content you provide to Digital Derek.
You give West Pro Media Services Ltd permission to process that information only as reasonably necessary to provide, operate, secure, support and improve Digital Derek in accordance with the Privacy Policy and these Terms.
You should not deliberately submit another person’s confidential or sensitive personal information unless you have a lawful and appropriate reason to do so.
16. Digital Derek and Derek’s intellectual property
Derek McGillivray / A Happy Medium retains rights in Derek’s underlying source material, teachings, writing and other content as applicable.
Other Digital Derek software, design, branding, platform content and materials may be protected by intellectual-property rights belonging to West Pro Media Services Ltd or the relevant rights holder.
Your membership gives you a personal right to use Digital Derek.
It does not transfer ownership of the underlying knowledge base, prompts, systems, Derek source material, branding or other protected content.
You may keep and use your own generated reflections for your personal purposes.
You may not reproduce, redistribute or commercially exploit protected Digital Derek or Derek source material without permission.
17. AI-generated reflections
Digital Derek uses artificial intelligence.
Although the service has been designed carefully around Derek’s approved material and is subject to ongoing quality review, AI-generated content can sometimes be incomplete, inaccurate, unexpected or unsuitable for a particular situation.
You should use your own judgement when considering a reflection.
Where a matter requires professional advice, specialist expertise or urgent intervention, seek appropriate professional help.
18. Derek’s involvement
Digital Derek is not a live one-to-one service with Derek.
Membership does not include personal coaching, mediumship, counselling, consultations or other direct sessions with Derek.
Derek is Digital Derek’s knowledge and content partner and may review selected Digital Derek interactions on a random or ad-hoc basis for quality assurance and continuing development.

19. Availability of the service
We aim to make Digital Derek available reliably, but we do not guarantee that the service will be uninterrupted or error-free at all times.
Digital Derek may occasionally be unavailable because of:
- maintenance
- upgrades
- technical problems
- internet or infrastructure failures
- third-party service outages
- security issues
- circumstances outside our reasonable control
We will take reasonable steps to restore service where an interruption occurs.
20. Changes to Digital Derek
Digital Derek will continue to develop.
We may add, remove or change features, technology, models, interface elements or other aspects of the service where reasonably necessary to improve, maintain or secure it.
We will provide appropriate notice where a material change significantly affects an existing paid membership.
21. Price changes
We may change the Digital Derek membership price in the future.
Existing paid members will receive at least 30 days’ notice before a price increase takes effect for them.
A new price will not be applied retrospectively to a billing period that has already been paid for.
If you do not wish to continue at the new price, you can cancel before the change takes effect.
22. Suspension or termination
West Pro Media Services Ltd may restrict, suspend or terminate access where reasonably necessary because of:
- non-payment
- unlawful use
- serious or repeated misuse
- attempts to compromise the platform or another user’s data
- fraudulent activity
- material breach of these Terms
- a security risk
- a legal or regulatory requirement
Where serious misuse or an immediate security or legal risk exists, access may be suspended or terminated immediately.
Where appropriate, we will explain the reason and provide an opportunity to contact support.
23. Privacy and personal information
Personal information is handled in accordance with the Digital Derek Privacy Policy.
The Privacy Policy explains what information is processed, the involvement of AI providers and authorised administrators, retention periods and members’ data-protection rights.
24. External websites and services
Digital Derek may link to independent third-party websites and services, including support organisations, A Happy Medium and external service providers.
We are not responsible for the content, availability or privacy practices of independent third-party websites.
External links are provided for convenience or information and do not necessarily constitute endorsement of everything published by the third party.
25. Our responsibility to you
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded under consumer law.
West Pro Media Services Ltd is responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not reasonably foreseeable when the contract was made or that results from circumstances outside our reasonable control.
Digital Derek is supplied for personal and non-commercial use. We are not responsible for business losses arising from use of a consumer membership, including loss of profit, revenue, business opportunity or business interruption.
Your statutory rights as a consumer are not affected.
26. Governing law
These Terms and your Digital Derek membership are governed by the law of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you continue to benefit from any mandatory consumer protections that apply to you and may have rights to bring proceedings in the courts available to you under applicable consumer law.

We may update these Terms where Digital Derek, legal requirements or commercial arrangements change.
Where a material change affects existing paid members, we will provide appropriate notice.
